Welcome to Magnum Luksu. These Terms and Conditions regulate the access, browsing, and use of the website, as well as the purchase of products offered through our official digital channels in Colombia.

By accessing, browsing, registering, making a purchase, or using any of our services, you agree to have read, understood, and accepted these Terms and Conditions, as well as our supplementary privacy, shipping, exchange, return, warranty, and refund policies, where applicable.

If you do not agree with these Terms and Conditions, you should refrain from using this site and making purchases through our digital channels.

Magnum Luksu operates an e-commerce channel aimed at selling products to consumers in Colombia, subject to availability, logistics coverage, and internal order, payment, and security validations.

2. Capacity to purchase and permitted use

By making purchases on this site, you declare that you have the legal capacity to contract according to applicable law and that the information provided is true, complete, current, and verifiable.

The use of this site must be lawful, responsible, and in good faith. It is prohibited to:

• use the site for fraudulent, illegal, or unauthorized purposes;
• impersonate third parties or provide false or misleading information;
• interfere with the security, stability, or operation of the site;
• attempt unauthorized access to accounts, databases, servers, or related systems;
• reproduce, exploit, distribute, or misuse site content without authorization.

Magnum Luksu strives to ensure that the product information published on the site is clear, sufficient, and updated. However, inventory availability may vary and is not absolutely guaranteed until the order has been internally validated and confirmed.

There may be reasonable differences in tone, texture, visual perception, or packaging due to lighting, editing, supplier, batch, screen, or user device, without necessarily implying a product defect.

Magnum Luksu reserves the right to update, modify, replace, discontinue, or limit products, references, prices, promotions, and availabilities without prior notice, except for orders already confirmed in accordance with applicable regulations.

5. Prices, currency, and taxes

All prices published on the site are expressed in Colombian Pesos (COP), unless another currency is expressly indicated.

Prices may or may not include applicable taxes, fees, logistics charges, or other values, as indicated on the product sheet, cart, order summary, or checkout before completing the purchase.

Magnum Luksu may change prices at any time. However, the price applicable to the order will be the one informed to the customer before successfully completing the purchase process, except for notorious errors, obvious technical problems, or force majeure situations affecting the price publication.

6. Promotions, coupons, and discounts

Promotions, discounts, coupons, benefits, gifts, or commercial campaigns will be subject to specific conditions of validity, availability, coverage, minimum purchase amount, participating references, limited units, and other restrictions informed in each campaign.

Unless expressly stated otherwise, promotions are not cumulative.

Magnum Luksu may cancel or reject promotional benefits obtained through fraud, system abuse, obvious error, technical manipulation, improper use of codes, or non-compliance with campaign conditions.

7. Purchase process and order formation

The customer may select products, add them to the cart, fill in the requested information, choose the available payment method, and confirm the order. The submission of the order by the customer constitutes a purchase intention subject to review, validation, and acceptance by Magnum Luksu.

Automatic order reception, the sending of a receipt email, or the display of an order number does not signify definitive acceptance of the transaction.

Magnum Luksu may reject, limit, or cancel orders when:

• the product is not available;
• there are inconsistencies in payment or customer data;
• signs of fraud, misuse, or transactional risk are detected;
• there are notorious errors in price, publication, inventory, or site configuration;
• there are logistical, regulatory, or coverage restrictions.

In case of rejection or cancellation of an already paid order, the customer will be informed, and the corresponding refund will be processed when applicable.

8. Payment methods and validation

The site may enable different payment methods, including electronic instruments, payment gateways, transfers, cards, or other mechanisms available at the time of purchase.

Payment approval is subject to validations by the issuer of the payment instrument, the gateway, the bank, the financial operator, and fraud prevention systems. Magnum Luksu does not guarantee automatic approval of any transaction.

In cases of reinforced validation, Magnum Luksu may request additional information before approving and dispatching the order.

9. Shipping and deliveries

Shipping conditions, estimated times, costs, coverage, delivery attempts, logistical updates, and other operational aspects are regulated by Magnum Luksu's current Shipping Policy.

The informed delivery times are estimates and may vary by city, coverage, inventory availability, carrier, commercial season, weather updates, mobility restrictions, high demand, or force majeure events.

It is the customer's responsibility to correctly provide the address, phone number, email address, recipient's name, and other necessary data for effective delivery.

10. Right of withdrawal

For purchases made by non-face-to-face means, the consumer may exercise the right of withdrawal within five (5) business days following the delivery of the product.

To exercise the right of withdrawal, the product must be returned in suitable condition, unused, unaltered, with its accessories and original packaging when applicable, and complying with other conditions informed in the corresponding policy and by law.

The right of withdrawal will not apply in cases exempted by applicable legislation.

11. Payment reversal

When the purchase has been made through electronic commerce mechanisms and using electronic payment instruments, the consumer may request a payment reversal in legally stipulated cases, including fraud, unsolicited operation, product not received, defective product, or product not corresponding to what was requested.

The consumer must follow the applicable legal procedure with the financial institution or issuer of the payment instrument and also notify Magnum Luksu within the terms provided by current regulations.

12. Exchanges, returns, warranties, and refunds

Specific conditions for commercial exchanges, returns, legal warranties, and refunds will be governed by the policy published for that purpose by Magnum Luksu and by Colombian consumer protection regulations.

In no case may Magnum Luksu's internal policies be interpreted as limiting inalienable rights recognized by Colombian legislation for the consumer.

13. Order cancellation by Magnum Luksu

Magnum Luksu may cancel orders before dispatch when objective circumstances justify it, such as:

• actual inventory depletion;
• impossibility of payment validation;
• risk of fraud or abusive use of the channel;
• obvious material errors in price or publication;
• legal or logistical compliance restrictions.

If the order has already been paid, the customer will be informed, and a refund will be processed when applicable.

14. Intellectual property

All content on the site, including texts, photographs, designs, trademarks, logos, trade names, graphics, interfaces, software, advertising pieces, videos, catalogs, descriptions, and other visual or auditory elements, is the property of Magnum Luksu or its licensors and is protected by applicable intellectual property regulations.

Its reproduction, distribution, transformation, extraction, public communication, commercial use, or unauthorized exploitation, in whole or in part, is prohibited without prior express authorization from the corresponding owner.

15. Links and third-party services

The site may integrate or link services, applications, payment gateways, technological tools, social networks, marketplaces, logistics operators, or other third parties. The use of such services may be subject to the terms, conditions, and policies of those third parties.

Magnum Luksu does not fully control third-party services and assumes no responsibility for events exclusively attributable to them, without prejudice to the legal responsibilities that may arise in the specific consumer relationship.

16. Personal data protection

The processing of personal data carried out through the site is governed by Magnum Luksu's Privacy and Personal Data Processing Policy.

By providing personal data through the enabled channels, the user declares to have been informed of the purposes, rights, and contact mechanisms established in said policy.

17. Limitation of liability

Magnum Luksu makes reasonable efforts to keep the site available, secure, and updated. However, it does not guarantee that the site will operate uninterruptedly, error-free, virus-free, or completely immune to technical failures, external events, cyberattacks, third-party service outages, maintenance, network congestion, or force majeure causes.

In no case will Magnum Luksu be liable for indirect, incidental, or consequential damages arising from the improper use of the site by the user, non-compliance with instructions, errors in the information provided by the customer, or events exclusively attributable to third parties beyond its reasonable control, without prejudice to the minimum consumer rights provided by Colombian law.
